Sealed bids for the furnishing of all labor and material necessary for RFB-UC22-149C – PIN 8758.04 KINGSTON RAIL TRAIL: will be received by the Ulster County Director of Purchasing, 100 Development Court, Kingston, New York 12401 until 3:00 PM local time on December 8, 2022, at which time and place they will be publicly opened and read aloud. The project involves the construction of a 1.8 mile asphalt multi-use path along the former O&W rail corridor from Washington Ave in the City of Kingston to the existing O&W Rail trail adjacent to NYS Route 209 in the Town of Hurley. The trail includes the construction of a 10 ft. wide asphalt multi-use path, 2 ft. wide turf shoulders, pedestrian railing, three new short span bridge structures, culvert rehabilitation, drainage improvements, landscape appurtenances and the construction of a trailhead at Washington Ave. This project utilizes alternate bidding procedures, see section 100 of the contract documents for further details. Each bid must be accompanied by security in an amount not less than five percentum (5%) of the amount of the bid in the form and subject to the conditions provided in the Information for Bidders. The Sponsor and the New York State Department of Transportation, in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C. 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally-assisted programs of the Department of Transportation and Title 23 Code of Federal Regulations, Part 200, Title VI Program and Related Statutes, as amended, issued pursuant to such Act, hereby notifies all who respond to a written Department solicitation, request for proposal or invitation for bid that it will affirmatively insure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, national origin, sex, age, disability/handicap and income status in consideration for an award. All work items of the Contract shall be substantially completed within 270 calendar days following the date the Contractor is notified to proceed with the work unless such period is extended by the Owner as provided herein. This is a locally administered Federal Aid project subject to the approval and oversight of the New York State Department of Transportation (NYSDOT) and follow the Local Projects Manual. As such the following are requirements of the project: • All contractors and subcontractors shall use the Equitable Business Opportunity Solution (EBO) to monitor and report on contract payments, workforce goals, and DBE goals. • The Lowest Bidder and all sub-contractors shall submit/have an approved CCA-2 form. • The Prime contractor shall submit the completed Non-Collusion forms with their bid. • The Prime contractor shall submit the completed Lobbying activities form with their bid. • There are no residential or geographical restrictions related to this project. • The successful bidder will provide performance & payment bonds, insurance, and execute the contract. All work shall be completed in accordance with NYSDOT Standard Specifications for Construction and Materials dated September 1, 2022. The right is reserved by the County to waive any informalities in the Bid and to reject any or all Bids. The Bidder shall promptly notify the County of any errors, omissions, conflicts, ambiguity, etc. in/among the contract documents.
